Hank Langstroth, Elizabeth McGrath, Meredith deCarbonnel, and Keevin Geller were the members present. Chairman, Peg Arguimbau, arrived at 8:15 p.m.

7:45 p.m., N. O. I. Public Hearing filed by 1245 Providence Highway Realty Trust for the proposed pavement of an existing gravel parking area and drainage improvements within the 100’ Buffer Zone at 1245 Providence Highway, DEP FILE #SE-280-0513:

Present: Applicant, Donnell W. Murphy, Trustee. Engineer, Rick Merrikin, from Merrikin Engineering.

Rick Merrikin appeared before the Commission to represent the Applicant. He submitted the
green abutter cards to the Commission, and a proposed plan entitled, “1245 General Edwards Highway, Existing Watershed Site Plan of Land in Sharon, MA,” dated February 8, 2010. The delineated wetlands on the proposed project site were approved by the Commission for a previous
project. The proposed project is located in the Light Industrial Zone within the Groundwater
Protection District. Rick explained to the Commission that the scope of the proposed project is to
pave the existing gravel parking area located on the northeast side of an existing building and proposed drainage improvements to the paved parking area. The Applicant is meeting with the ZBA on April 28, 2010, to request a variance concerning the recreational use of the existing building on the proposed project site. Rick indicated that upon ZBA approval concerning the Applicant’s variance request, portions of the existing building will be used for recreational programs such as youth sporting activities and inflatable play structures. In addition to paving the existing gravel parking area, the Applicant is proposing to pave a small area at the front of the existing building for the purpose of creating a few new parking spaces. The proposed drainage improvements include the installation of a catch basin, curbing, stormceptor treatment unit, and an underground infiltration system.
Approximately 40% of the proposed pavement and all of the drainage improvements are located within the 100’ Buffer Zone to the BVW on the site.
The Applicant is proposing to restore the wooded section of an existing drainage swale that is located on the eastern side of the gravel parking area because is not functioning properly due to phragmites, silt, and debris. The Applicant proposes to use a small backhoe to remove the fallen trees and shrubbery from the existing drainage swale area.
Hank Langstroth inquired if there are any proposed changes to the existing grade area for the proposed paving project.
Rick replied that the existing grade area will remain unchanged.

The Conservation Administrator requested the Applicant to submit additional details to the Commission for the proposed restoration work within the existing drainage swale area of the site.
Meredith deCarbonnel requested that the Applicant submit a series of photos of the existing drainage swale area for the Commission’s review.
Rick Merrikin agreed to comply with the Commission’s requests.
Hank Langstroth called for a motion to continue the hearing until May 6, 2010 at 7:45 p.m.

8:30 p.m., The Commission discussed the Enforcement Order issued to Michael Intoccia concerning  the Bella Estates Subdivision project, DEP File #SE-280-0455:

The Conservation Administrator and the Commission reviewed the Enforcement Order issued to Michael Intoccia on April 1, 2010, due to the serious erosion problems from the Bella Estates Subdivision project. The Conservation Administrator explained that someone should be accountable
for New England Environmental’s professional fees for their erosion control and improvement recommendations concerning the development project.
The following is a list of some of New England Environmental’s recommendations that Attorney Shelmerdine agrees to comply with as a result of a recent site inspection:
  • The installation of siltfence along the limit of work, including the cul-de-sac area of the project site.
  • The proposed installation of  ¾” stones along the apron areas where the driveways and roadways connect.
  • Hydro-seeding is being proposed in some of the disturbed areas of the site.
  • The installation of stone aprons around each of the catch basins on the site.
  • The installation of drainage swales at the front and back areas of the site.
  • The proposed installation of jute or coir fabric on top of the drainage swales.
  • To start mitigation control measures at the top of the site by installing stone, siltfence, jute mat, and some of the flocculants recommended by New England Environmental before removing the sediment deposits from the detention basin at the bottom of the site.
  • To clean out the level lip spreader by the outlet at the bottom of the site.
  • To reposition the board at the outlet of the detention basin adjacent to the cul-de-sac, to prevent sediment deposits from discharging into the wetlands during normal rain events.
The Conservation Administrator requested that the Applicant cover the large stockpile of soil near the cul-de-sac area with a fabric tarp to prevent sediment deposits from discharging into the drainage system on the site.
Peg suggested that Attorney Shelmerdine and Bobby Hearn consult with the Conservation Administrator to draft a work schedule to address the erosion problems on the project site.
Attorney Shelmerdine agreed to meet again with the Commission on May 6, 2010 at 7:45 p.m., for an update on the work sequence schedule for the development project.
Peg requested that Attorney Shelmerdine contact Fred Bottomley for an update on the Cranberry Bogs adjacent to Old Post Road.
Attorney Shelmerdine agreed to comply with Peg’s request.
Attorney Shelmerdine mentioned to the Commission that he is meeting with the ZBA on
April 28, 2010 concerning the proposed Sharon Commons Life Style Project. The Applicant is seeking a special permit from the ZBA to allow an increase in the building size of Anchor #1 to approximately
86,000 square feet, as opposed to the 80,000 originally approved.
Following the Commission’s review of the violation issues at the Bella Estates Subdivision, the Commission agreed to ratify the Enforcement Order issued to Michael Intoccia, on  April 1, 2010.
Peg called for a motion for the Commission to ratify the Enforcement Order issued to Mr. Intoccia, 155-157 N. Main Street, Sharon, MA 02067, DEP File #SE-280-0455.
Keevin Geller moved. Elizabeth McGrath seconded. Voted. Unanimous. 5-0-0.

8:50 p.m., Old/New Business:

- Request for an Order of Conditions Extension Permit from the Briggs Pond Homeowner’s Trust concerning Briggs Pond, 610 Mountain Street, DEP File #SE-280-249:

The Commission reviewed and agreed to issue an Extension Permit for the management of an Aquatic Vegetation Management Program at Briggs Pond. The last extension was issued in 2007 for a three year period.
Peg called for a motion to grant the request from the Briggs Pond Homeowner’s Trust to extend the Order of Conditions under DEP File # SE-280-249 for another three years with the understanding that this will be last extension without another presentation from the Briggs Pond Homeowner’s Trust.

8:55 p.m., Approve Past Meeting Minutes:

Peg called for a motion to approve the March 18, 2010 Meeting Minutes as presented.
Hank Langstroth moved. Elizabeth McGrath seconded. Voted. 4-0-1.

The Conservation Administrator notified the Commission that the Sharon Friends of Conservation has donated $500.00 to the Commission’s Land Acquisition Account. The donation was made possible by the proceeds received from the Open Spaces, Special Places, book sales.

The Commission requested that the Conservation Administrator formally withdraw its application submitted to the C.P.A. Committee because C.P.A. funds may not be used toward the Massapoag Sportsmen’s Club Conservation Restriction stewardship fee.  

Hank Langstroth and the Conservation Administrator recently met with the Finance Committee concerning the Commission’s Reserve Fund Transfer Request for funding the Massapoag Sportsmen’s Club Conservation Restriction stewardship fee. The Conservation Administrator has submitted the information requested by the Finance Committee and is awaiting their approval.
